Minutes

To approve as a correct record and sign the minutes of the meeting held on 6 September 2017.

Minutes:

The Minutes (copies of which had been circulated) of the meeting held on 6 September 2017 were approved as a correct record and signed by the Chair.

2.

Exclusion of the Public and the Public Interest Test

To consider whether it is in the public interest to exclude the public during the consideration of agenda items 6-11 that are marked "not for publication" by virtue of the paragraph 1 of the Local Government Act 1972 (as amended), as they contain ‘information relating to an individual’.

 

Minutes:

RESOLVED – That the public be excluded from the meeting during consideration on Items 6-11 to prevent the disclosure of information which was not for publication relating to an individual as defined in Category 1 of Schedule 12A of the Local Government Act 1972 (as amended), the disclosure of which would not be in the public interest, would not be fair to the applicant and would breach their data protection principles.

Declarations of Interest

Councillors and officers to declare any interests which they have in any of the items on the agenda for the meeting.

Councillors and Officers were invited to declare any interest which they may have had in any of the items on the agenda for the meeting.

 

No declarations of interest were made.

4.

Urgent Decisions

To report any urgent action taken under the constitution since the last meeting of the Committee.

 

Following consultation with and the agreement of, the Chair of the Licensing, Environment and Safety Committee, the Corporate Director for Place Management and Regeneration has taken urgent action to amend the resolution of the Committee of 6 September 2017 relating to the redesignation of a number of sites in the Town Centre for the purpose of Street Trading.

 

The amended resolution reads as follows:

 

i) “Give approval to the change the designation of the sites identified and described in Appendix A of this report from their current status as Prohibited Streets to Consent Streets for street trading under Schedule 4 of the Local Government (Miscellaneous Provisions) Act 1982, with the redesignation to take effect from 1 November 2017.

 

(ii) “Give approval to the revised Town Centre Consent Streets Terms & Conditions (described in Appendix B of this report)

 

(iii)“Give approval to a modification to the Council’s Street Trading Policy (described in Appendix C of this report).

 

(iv)“Authorise the Corporate Director, Place to issue the necessary notices required under the Local Government (Miscellaneous Provisions) Act 1982.”

 

Minutes:

A representative of the Corporate Director for Place Management and Regeneration reported that the Corporate Director, in consultation with the Chair, had taken action to suspend the licenses of 36 hire car drivers.

Members of the public are invited to put questions to the Chair and members of the Committee on any matters within the powers and duties of the Committee, subject to the exclusions set out in the Code of Practice. (Questions must be submitted prior to the commencement of the meeting on the cards provided.  These are available at the meeting).

The Committee interviewed the applicant, who was accompanied by his wife and solicitor, in relation to these matters.

 

RESOLVED – That the application be granted.
